Terms of Service
1. Agreement to these Terms
These Terms of Service ("Terms") form a binding agreement between you and BuildDaily ("BuildDaily," "we," "us," or "our"), the operator of Comment Convert (the "Service"). By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the right and authority to manage the connected accounts on the platforms you connect to Comment Convert.
3. Your account
- You are responsible for the activity that happens under your account and for keeping your login credentials secure.
- You agree to provide accurate information when creating your account and to keep that information up to date.
- Notify us promptly at hello@commentconvert.com if you believe your account has been compromised.
4. Connected platforms
The Service lets you connect third‑party platforms (such as YouTube and TikTok) to read and respond to comments on content you own or are authorized to manage. Your use of those platforms remains subject to their terms of service and policies. You are responsible for complying with the terms of any platform you connect, including (without limitation) TikTok's Community Guidelines, Terms of Service, and Developer Terms.
You authorize Comment Convert to access and process information from the platforms you connect, only as described in our Privacy Policy and only to the extent needed to provide the Service. You may revoke that authorization at any time from inside Comment Convert or from the platform's connected‑apps settings.
5. Acceptable use
When using Comment Convert, you agree not to:
- Send spam, mass unsolicited replies, or content that violates the rules of any connected platform.
- Use the Service to harass, threaten, defame, or impersonate any person or entity.
- Generate or publish replies that are illegal, hateful, sexually explicit, deceptive, or that infringe anyone's rights.
- Reverse‑engineer, scrape, or attempt to extract source code from the Service, except as expressly permitted by law.
- Interfere with or disrupt the Service, or attempt to gain unauthorized access to any part of it.
- Use the Service to access comments on content you do not own or are not authorized to manage.
- Misrepresent who is replying — for example, by using the Service to impersonate another creator.
We reserve the right to suspend or terminate accounts that violate these rules.
6. AI‑generated content
Comment Convert uses AI to suggest draft replies based on the comment text and the voice examples you've approved. You are responsible for reviewing each draft before publishing it. You acknowledge that AI‑generated text can be inaccurate or inappropriate and that you, not Comment Convert, are responsible for any reply you send.
7. Your content
You retain ownership of the content you submit to Comment Convert (including voice examples, notes, and edits to drafts). You grant BuildDaily a worldwide, non‑exclusive, royalty‑free license to host, store, process, and display your content solely for the purpose of providing the Service to you. We will not use your content to train AI models for other customers or third parties, as further described in our Privacy Policy.
8. Our intellectual property
The Service, including the Comment Convert name, logo, website, software, and underlying technology, is owned by BuildDaily and is protected by intellectual property laws. We grant you a limited, non‑transferable, non‑exclusive, revocable license to use the Service in accordance with these Terms. No other rights are granted.
9. Fees
Comment Convert is free during early access. We will notify you in advance before introducing paid plans, and your continued use of the Service after a paid plan is introduced will be subject to the pricing and additional terms presented at that time.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if your continued use creates legal exposure for us, or if we discontinue the Service. On termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, BuildDaily disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non‑infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error‑free, secure, or that AI‑generated drafts will be accurate or appropriate for any particular use.
12. Limitation of liability
To the maximum extent permitted by law, in no event will BuildDaily, its affiliates, or its service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities arising out of or related to your use of the Service. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
13. Indemnification
You agree to defend, indemnify, and hold harmless BuildDaily and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any platform terms or applicable law, or (d) any reply you publish using the Service.
14. Changes to the Service or Terms
We may modify the Service (adding, removing, or changing features) and we may update these Terms from time to time. If we make material changes to the Terms, we'll notify you by email or by a prominent notice in the Service before the changes take effect. Your continued use of the Service after the effective date of an update constitutes your acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict‑of‑law principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in Delaware, and you and BuildDaily consent to the personal jurisdiction of those courts. Nothing in this section limits any non‑waivable rights you have as a consumer under the laws of your country of residence.
16. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and BuildDaily regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
